These Terms of Use govern your access to and use of apartmentrentals.miami (the "Site"), operated by BAO Real Estate LLC, a Florida licensed real estate brokerage (License #CQ1073975). By using the Site, you agree to these terms.

Use of the Site

You may use the Site for personal, non-commercial purposes related to renting an apartment. You may not scrape, copy, or redistribute listing content, photos, or other materials without our written permission.

Prohibited uses

You agree not to:

• Use the Site for any unlawful, fraudulent, or harmful purpose, or in violation of any applicable federal, state, or local law (including fair housing laws).
• Harass, threaten, defame, or discriminate against any person, including our staff, partner buildings, or other users.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Submit false, misleading, or fraudulent information through any form on the Site.
• Scrape, crawl, harvest, copy, frame, mirror, or redistribute any portion of the Site, listings, photos, or content without our prior written consent.
• Attempt to gain unauthorized access to the Site, our systems, user accounts, or partner-building systems.
• Introduce viruses, malware, or other malicious code, or otherwise interfere with, disrupt, overload, or attempt to probe, scan, or test the vulnerability of the Site or its infrastructure.
• Use the Site to send spam, unsolicited communications, or to collect personal information about other users.
• Use any automated means (bots, scripts, scrapers) to access the Site without our express written permission.

We may suspend or terminate your access to the Site at any time, without notice, for any violation of these Terms.

Accuracy of information you submit

When you submit information through any form on the Site (including contact, get-matched, application, and newsletter forms), you represent and warrant that the information you provide is true, accurate, current, and complete, that you are at least 18 years old, and that you have the right to provide it. You agree to update your information as needed to keep it accurate. Providing false or misleading information may result in termination of your access and may expose you to civil or criminal liability.

Listing information

All pricing, availability, concessions, floor plans, photos, and amenities are provided by third-party property owners and managers and are deemed reliable but not guaranteed. Information is subject to change without notice. Always verify directly with the property prior to leasing.

No guarantee of availability

Listings displayed on the Site are for informational purposes only and do not constitute an offer to lease, a reservation, or a binding commitment of any kind. A unit shown on the Site may already be leased, withdrawn from the market, or unavailable at the time of your inquiry. Pricing and concessions may change without notice and are not guaranteed until a fully executed lease is signed by the property owner. We make no representation or warranty regarding the continued availability of any unit, price, special, or amenity displayed on the Site.

No fee model

Our locating service is free to renters. Partner buildings pay us a referral fee when a lease is signed.

No agency or brokerage relationship

Use of this Site, submission of a contact or matching form, or communication with our team does not create a brokerage, agency, fiduciary, or client relationship of any kind between you and BAO Real Estate LLC or any of its agents. No agency relationship is formed until a separate written representation agreement is executed by both parties. Until such time, any information provided by our team is for general informational purposes only and does not constitute professional real estate, legal, tax, or financial advice.

Intellectual property

All content on the Site — including text, graphics, logos, photographs, video, interface design, software, and the Miami Apartment Rentals name and brand — is owned by or licensed to BAO Real Estate LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, publish, display, modify, scrape, frame, or create derivative works from any portion of the Site without our prior written consent. Listing photos and descriptions are provided by partner buildings and remain the property of their respective owners.

DMCA notices. If you believe content on the Site infringes your copyright, send a written notice with the information required by 17 U.S.C. § 512(c)(3) to info@apartmentrentals.miami with the subject line "DMCA Notice."

Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, BAO Real Estate LLC and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or revenue, arising out of or related to your use of the Site or our services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to these Terms or the Site shall not exceed one hundred U.S. dollars ($100.00).

Indemnification

You agree to defend, indemnify, and hold harmless BAO Real Estate LLC and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of the Site or violation of these Terms; (b) your violation of any law or the rights of any third party; or (c) any content you submit to us.

Changes to these Terms

We may update these Terms at any time at our sole discretion. The "Last updated" date at the top reflects the most recent revision. Material changes will be indicated by updating that date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
